So Sue Me!

This is a common phrase that many people say, but many have taken too seriously. The amount of lawsuits over unimportant things like spilled coffee are on the rise and people are looking for reasons to sue. People have broken into houses and hurt themselves in the process sue the owners for it. Health lawsuits have increased so much that doctors can't practice because the insurance is too high to do so. Emergency workers can't rescue people without worrying about being sued. It is a problem that has to be taken care of. People need to stop sueing over the unecessary things and if we don't put an end to it, people won't be able to work certain jobs anymore because they can't afford to. Lawyers who hunt for cases to fight like that spilt coffee case need to be stopped. What Do you think?

I agree you people are suing for any and everything these days. Their need to be laws implemented to the things people can sue for. I actully know a doctor that moved to a diffrent state because the insurance was to high here in GA. You know it is bad when people are cutting of their fingers to put in food just for the sake of a lawsuit.

I want to play devils advocate for a second here and get your thoughts on how laws can be placed without limiting rights. People could protest and say that sueing is a form of speech and limiting it violates the 1st admendment.

I think some of it is ridiculous. I think a lot of times people are just looking for something to sue someone over. I also think a lot of times the settlements they're walking away with are huge and not entirely deserved. But on the other hand you should be able to sue a company for a legitimate reason.. So it's hard to tell where you draw the line. It would be practically impossible to regulate.

I think we should still have the right to sue BUT I believe that if you sue AND it is determined that your lawsuit was frivolous, you should have to pay for every penny the defendant had to spend for representation and for lost wages.
This topic makes me ask the question: If we had socialized medicine in this country, would you still have the right to sue? The doctors would not be able to afford malpractice insurance premiums if they were on a socialized medicine salary.

I totally agree that people now a days sue over everything. I read an article about this guy that sued a flower company because they sent him a thank you card in the mail, and his wife saw it and found out he was cheating. So he blamed the flower company for his divorce.

This blog coudn't have come at a better time. So last night my boyfriend and I were dining at a cheap pizza buffet. As we were eating he pulled a long back hair out of his salad. The first thing that came out his mouth (besides the hair) was, "do you think that I can sue them for this?" I replied with,"are you serious!" I mean seriously what do you expect when you pay $4.49 for a buffet! People in America are so sue happy that it is ridiculous!
I hear that on a daily basis in my field of employment "I'm going to sue!" It gets really old. People just want easy money.
I understand when there is a legitimate reason. Like went someone really gets hurt at someone elses fault. But when you break into someones house and fall and break your leg you have no right to sue. That's just karma! Or when you get into a little fender-bender don't fall out and say your having cronic neck and back pain. Give me a break!

I think that people should have the right to sue. Now, yes SOME people are taking it to far. Unfortunately, that is what the world has come to today. Some people are always looking for a way to make a dollar instead of working like the rest of us.
Trying to pass a law like this will never happen. So that leaves the rest of us to just get over it. Whether we like it or not.Until we have been put in a position to where we might have to sue we don't know what we would do. The outcome of your case could make me say "are you kidding me"? "You sued for what"? No one ever knows what they would do until they walk in those suing shoes.

amanda, I completly agree. There is no way that a law limiting suing will ever come to be because those same sharks representing these unecessary lawsuits are the same ones who are going to defend their rights and win. As for the flower guy? He should have taken responability for his actions and not sued. That is why we have so many of these ridiculous lawsuits. People don't want to take responsability for what they do and they want to make money off of someone else's hard work. Also these lawsuit sharks come and offer them thousands if they sue over their condition. Each case has some greedy lawyer behind it willing to sell their souls for the cut they get.

What about a law that limits the amount of money you can receive from a lawsuit? For example, the hot coffee lawsuit should not have an award more than a few thousand dollars.

i was recently put into a legal situation. The situation involved a car accident which occurred while running an errand for my work. After talking to a few of my friends and my father, they convinced me that I was liable for workers compensation to get my car fixed. I confronted my general manager and the owner of the restaurant I work at and I felt as if they were not giving me a straight answer. I felt ignored and not important when the issue was brought up. This is where my legal situation falls into place. I'm not sure if I should take this into legal matters.

I agree people are sue happy these days. Like the man sueing for millions because the local dry cleaners lost his pants. PANTS? Those pants probably cost $ 100.00!
It's such a waste of time and money. If you have a legit case, that's one thing but it seems like people are looking to sue for "easy money" and sadly, sometimes they get it...

Melody,

I was going to bring up the pants!!! That's my favorite story. The guy was ridiculous. He basically ended up harrassing these small business owners.

Most people want to "make it right."

People should have a right to sue, but our judicial system should determine a fair amount for all parties involved. There is no reason someone should get rich off of someone else's mistake. The only exception I can think of would be the loss of a loved one.

Michelle B. said...

I agree with limiting the amounts except that limilts the Judge in what he thinks is fair and it also can prevent someone from really getting the amount they deserve when they actually deserve more then the limited amount. As for the pants guy, that's rediculous! David, do what you think is right and just. Do you guys think that there should be a law limiting the amounts?

Wow, i'm so glad you brought up this issue. It does cut back to two main things. Lawyers who want to make money off of anything and everything and peoples stupidity. You'll always have both.lol Or the world would'nt go round.

I agree that the united states law system has become a big joke. And most of it is because some lawyers that knows the law a little too well, who wants to make a name for themselves and who has gotten greedy made it easy for people to sue for silly reasons.
